Utah County arrest records are documents prepared and maintained by law enforcement agencies that contain information relating to the arrest and processing of individuals into police custody. These records may include details such as the circumstances of the arrest, the charges involved, and booking information.

Utah law recognizes the people’s right to access information about the government’s affairs. Accordingly, the Government Records Access and Management Act (GRAMA), specifically Utah Code § 63G-2-301, mandates all government entities, including those in Utah County, to maintain records relating to the conduct of the public’s business. 

The Utah County Sheriff’s Office and municipal police agencies such as Provo Police Department and Orem Police Departments, comply with this mandate by creating and providing public-facing means for accessing these records in accordance with the legal framework.

Are Arrest Records Public Information in Utah, Utah?

Utah County government records are classified as either public, controlled, or protected under the Government Records Access and Management Act. While arrest records are generally considered public information and are required to be provided to any person upon request, the disclosure of these records is subject to certain limitations that restrict access to confidential or sensitive information in a record. As a result, if a record contains information that is likely to cause physical or reputational injury or impair the effectiveness of an ongoing investigation, custodians are allowed to withhold these records or redact the sensitive portions before releasing it to a requester.

What Do Public County Arrest Records Contain?

The content of an arrest record typically varies by the facts that are allowed to be revealed by the legislative framework regulating access. 

Upon conducting a Utah County arrested persons search, certain portions of an arrest record are typically open and may be disclosed to the public. These include:

  • Full name
  • Year of birth
  • Date of booking

If the arrest resulted in charges, searching District and Justice criminal Court records online or at the courthouses is often the best way to retrieve these records.

The District Court is the court of general jurisdiction where all felonies and Class A misdemeanors are filed. 

The Justice Court handles Class B and C misdemeanors, infractions, and traffic cases. 

Public records of these cases, including the associated arrest files, can be accessed online using Xchange, the court's case management system.

This search tool provides access to case files, including arrests and final dispositions. Registered users may utilize this online resource to search for criminal case files tied to an arrest by name or case number for a fee. 

The Bureau of Prison also offers the BOP Inmate Locator Tool for conducting online searches for incarcerated individuals by name or file case number.

Because the Utah County Sheriff's office handles most of the county's arrests and is also responsible for managing the county jail, the office is the local resource for obtaining Utah County arrest information.

Active Warrant Search in Utah County

An arrest warrant is a document issued by a judge or magistrate authorizing law enforcement to arrest an individual, usually based on the suspicion that they have committed a crime. It is issued based on probable cause or evidence submitted by police suggesting a crime occurred and that the suspect committed it. A judge typically issues one when the evidence suffices to show that the suspect actually committed the crime. 

An arrest warrant often include the following details:

  • The name of the suspect
  • The allegations
  • The arresting agency to whom it is addressed
  • An order commanding law enforcement to arrest the suspect
  • The name of the court; and
  • The signature of the judge

The document serves to protect citizens against unlawful arrest under the fourth amendment. Once issued, a law enforcement officer obtains the requisite authority to arrest the audited anywhere they find him within state borders or may follow due process to have them extradited from where they may have been arrested in other jurisdictions.

How to Find Arrest Records for Free in Utah County

Summaries of Utah County arrest records are available for free through the Utah County Sheriff’s Office. Individuals can perform a web-based search for arrest records by visiting the Utah County Sheriff's Office website and navigating to inmate lookup to search by name, arrest date, and see the full list of arrestees currently being detained in the Utah County Jail. Searches for Utah County arrested individuals on this platform are free; no IDs required and no payment necessary. 

Upload of an individual's arrest information on the website may take up to 24 hours to complete. If the need to confirm an arrest is urgent, and the information is not appearing online,  individuals may visit the Utah County Sheriff’s Office in person to make an over-the-counter request. Records obtained in person are typically more comprehensive than the summaries available online. Furthermore, while inspection is free, the Sheriff's Office may charge for copies and mail deliveries.

Utah County Arrest Report

Arrest reports are written or recorded reports prepared by an arresting officer engaged in public patrol or response duties describing official actions initially taken in response to an apparent violation of law, which report may describe:

  • The date, time, and nature of the incident or the crime
  • Names of victims
  • The general scope of the agency's initial action taken in response to the incident
  • The general nature of any injuries or estimate of damages sustained in the incident
  • The name, address, and other identifying information about any person arrested or charged in connection with the incident; or
  • The identity of the public safety personnel

In contrast, arrest records are summary entries in a custodial or judicial case file or computer program. These entries serve to confirm that an arrest occurred and reveal the fact that the individual is currently being held. In Utah County, arrest records may include:

Arrest reports are typically considered as part of the internal investigative materials of an arresting agency, while arrest records are generally public, subject to certain limitations outlined in the regulatory statute.

How to Get an Arrest Record Expunged in Utah County

Under U.C.A. 77-40a-101(15) expungement is defined as the sealing of an arrest, investigation, detention, or conviction record so that it is no longer generally accessible except to certain government agencies. Upon expungement, the subject of the record is legally entitled to say that they have never been arrested or convicted of a crime.

In order to expunge an arrest, detention, investigation, or conviction record under Utah law, an individual must first obtain a Certificate of Eligibility. 

To do this:

  • Provide a copy of a valid government-issued ID card, e.g. passport, driver's license, consulate ID card, state ID.

Beyond what has been reported to the Bureau of Criminal Identification (BCI), qualification for expungement will be based on a thorough assessment of an individual’s entire criminal history, including incidents in other states and previous expungements. Once the assessment has been carried out, the individual will be unfriended via the return mail or email address.

How Do You Remove Utah County Arrest Records From the Internet?

Expungement is typically the basis for the removal of an arrest record from the internet. Once an order for expungement is signed by a judge and delivered to the BCI, the Bureau completely deletes all information about the charge both online and file at the headquarters. The Bureau will then proceed to store it in an expungement file that is only accessible to certain agencies listed in U.C.A. 77-40a-403(2).

Third-party websites are not necessarily subject to the same legal obligations unless specific enforcement measures are taken. As a result, each platform typically operates its own content removal procedure, which may require individuals to provide identification, official documentation such as certified court order, and the exact URL where the information about the arrest is published.
